Family Law Practice Areas

Many different situations arise that require a family law attorney. At Terry & Roberts, we handle them all, including:

Child Custody. There are several different potential outcomes for child custody, though Texas law tries to keep a level of shared custody between parents. Agreeing on what is legal but also most beneficial for your child can lead to a complicated legal process. Having an attorney on your side will protect your rights – and the rights of your child.

Paternity. Establishing paternity is an important part of many family law cases. Sometimes this is done voluntarily in order to obtain a formal record and the associated parental rights. Other times, a paternity test may need to be court-ordered.

Divorce. Divorce can often take a toll on you emotionally. And the separation of assets can be incredibly overwhelming – especially when things are not amicable between parties. Having a legal team on your side can ensure that your rights are protected and that you get what you deserve.

Child Support. When the custody arrangement is established, child support will be, too. The court will review the situation, income, and expenses, and will base ordered payment amounts accordingly. This amount usually falls within the Texas legal guidelines codified in the Texas Family Code.

Domestic Abuse and Protective Orders. Domestic abuse situations can escalate quickly within the home, putting you and your children in danger. You can ask the court to enter a protective order, giving your family a blanket of protection from the abuser. Due to the nature of these cases, you want to make sure everything is done perfectly so that there are no delays. It is best to seek legal representation.

CPS Defense. Unfortunately, it is not uncommon for a minor incident to escalate into something much more due to CPS involvement. If you are feeling threatened by this involvement or have been the victim of false claims, seek legal counsel immediately to protect your family.

Frequently Asked Questions

What should I do if CPS received a false report about my family?

By law, Child Protective Services (CPS) is required to follow up on every report they receive. Teachers, healthcare workers, social workers, law enforcement, and other professionals have a mandatory duty to file a report with the Texas Department of Family and Protective Services (DFPS) if they suspect child abuse or neglect.

More than half of the time the claims do not meet the requirements to take action. Again, however, these government agencies do have an affirmative obligation to investigate every claim.

Do both parties have to live in Texas to file for divorce here?

No, but at least one spouse must have lived in the state continuously for six months before filing for divorce. And, one spouse must be a resident of the county in which the divorce is being filed for at least 90 days prior to the filing.

How long do protective orders last?

There are different types of protective orders, each offering different protection and lasting for varying timeframes. For instance, an emergency protective order (EPO) can be issued immediately and last for 31 to 91 days. A temporary restraining order can last up to 20 days. More permanent orders can last much longer.
